Legal
Terms of Service
Effective 16 October 2026. These terms govern your use of SKAi Entertainment, operated by African Skyblue Technologies and Investments Pty Ltd. By creating an account or using the platform you agree to them.
Acceptance of terms
By accessing SKAi Entertainment, creating an account, publishing content or making a purchase, you accept these Terms of Service together with our AI content policy and Privacy Policy. If you do not agree, do not use the platform. Where you use the platform on behalf of an organisation, you confirm that you have authority to bind it.
Eligibility & accounts
You must be at least 16 years old to use SKAi Entertainment, or the minimum age of digital consent in your country, whichever is higher. You agree to register with accurate, current information and to keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account — tell us immediately at legal@skaitube.ai if you suspect unauthorised use. We may suspend accounts that provide false registration information or are created to circumvent a previous enforcement action.
AI-only content policy
The single rule that defines the platform
SKAi Entertainment is strictly dedicated to AI-generated entertainment. Every video, track, broadcast, podcast and event published here must be AI-generated, or AI-assisted within the declared thresholds set out in the AI content policy. Content outside that scope is out of scope for this platform and will not be published.
Upload declarations are binding statements. By publishing, you confirm that the tools, models, generation percentages, ownership claim and rights clearance recorded on the release are accurate. A false declaration is a material breach of these terms and can result in removal of the release and suspension of your account.
Creator obligations & licensing
- You keep ownership of everything you create on SKAi Entertainment.
- You grant the platform a worldwide licence to host, stream, format and promote your work.
- You keep an accurate AI declaration and provenance record on every release.
- You confirm you hold or have licensed every input, voice, likeness and sample you used.
- You warrant that takedown notices can be honoured for anything you publish.
Provenance records are created at upload and reviewed by SKAi Verify so that ownership and rights coverage stay auditable for the life of the release. Copyright concerns — including takedown requests — are handled under our copyright & provenance process, applying the notice-and-removal principles described in the AI content policy.
Marketplace & payments
Creators price, PayFast settles
Creators set the price of their own listings — tracks, albums, videos, tickets and digital goods. Checkout is handled by PayFast; we never store full card or bank details. An order is marked as paid only after a verified PayFast ITN callback confirms settlement — a client-side confirmation is never sufficient.
- Listings are priced by creators and displayed with all applicable platform fees.
- Creator revenue-share tiers are reviewed and approved by platform administrators.
- Payouts are released to verified creators and may remain pending review.
- Refunds and disputes are handled case by case through creator support.
Moderation & enforcement
We operate a moderation queue covering new uploads, edits, listings and live channels. Decisions include approval, labelling, restricted reach, removal and account suspension.
- Uploads enter a moderation queue with their declaration attached.
- Content labels are applied — or corrected — before and after publication.
- Repeated or serious breaches lead to suspension or permanent removal.
- Creators can appeal a decision and the review is handled by a human reviewer.
Prohibited conduct
- Infringing someone else's copyright, trademark, publicity or privacy rights.
- Posting unlawful, hateful, exploitative or non-consensual material.
- Uploading undeclared AI content or filing a false provenance declaration.
- Fraud, payment manipulation, fake engagement or review stacking.
- Harassment, impersonation, or doxxing of creators, staff or fans.
- Scraping, crawling or mass-downloading the catalogue outside published APIs.
- Circumventing security, rate limits, paywalls or moderation systems.
- Spam, malware, or unsolicited promotion inside comments and broadcasts.
Live & broadcast content
SKAiTV, SKAi Radio and creator broadcasts are subject to the same AI-only rules as on-demand releases. You are responsible for holding the rights to everything you stream, including any material played during a live event. We may cut a stream or remove a replay where there is a credible rights complaint, a safety issue or a policy breach. Recorded replays, schedules and programme metadata are published as part of the catalogue and remain subject to the same provenance declarations.
Disclaimers & limitation of liability
SKAi Entertainment is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any particular content will remain available.
Provenance scores produced by SKAi Verify are probabilistic signals, not guarantees of authorship, originality or ownership. They inform moderation decisions and public labels, but they are not a legal opinion or a substitute for your own rights clearance. To the maximum extent permitted by law, African Skyblue Technologies and Investments Pty Ltd is not liable for indirect, incidental, special, consequential or punitive damages, and its total aggregate liability arising out of the service is limited to the amount you paid to the platform in the twelve months before the claim.
Indemnity
You agree to indemnify and hold harmless African Skyblue Technologies and Investments Pty Ltd, its directors, employees and partners from any claim, demand, loss or expense arising out of your content, your declarations, your breach of these terms, or your infringement of another party's rights — to the extent permitted by applicable law.
Changes to terms
We may update these terms as the platform evolves. The current version always appears on this page with its effective date. Material changes will be announced on the platform or by email before they take effect. Continuing to use SKAi Entertainment after an update means you accept the revised terms; if you do not accept them, stop using the service and close your account.
Governing law
These terms are governed by the laws of the Republic of South Africa. Any dispute that cannot be resolved informally will be submitted to the competent courts of South Africa, without regard to conflict-of-law rules. Consumer protections that apply mandatorily in your country of residence are unaffected.
